Kirikiri 2 License Agreement

License for Kirikiri and KAG
---------------------------------------------------------------------------
2005/7/21 W.Dee
Please read the following license carefully before using this software.
If you do not agree to the following license, you may not use this software.
Please note that the licenses for Kirikiri 1 and Kirikiri 2 are different.
This license applies to Kirikiri 2 (and KAG 3).
● Dual License
The license for this software is provided as a dual license between the original Kirikiri license shown below and the GNU General Public License (GNU GPL).
Users may choose either the following license or the GNU GPL and use this software accordingly.
Regarding the GNU GPL, please refer to www.gnu.org or the attached files:
gpl-2e-plain.txt (Original; English)
gpl-2j-plain.txt (Japanese translation)
Some Kirikiri-related tools may be provided under other licenses (please read the respective documentation).
---------------------------------------------------------------------------
The following is an explanation regarding the original Kirikiri license.
For conditions not explicitly stated here, the copyright laws of the applicable country shall apply.
● Copyright
The copyright of this software is held by the author, W.Dee.
● Free of Charge
This software can be used free of charge. Users are not required to pay money to the author of this software.
This remains the same regardless of the nature of the software's use (commercial, free, shareware, etc.).
Here, "User" includes secondary users who utilize the works of primary users created using this software, as well as users who utilize the source code of this software.
● Termination of License
If a user violates this license, the user's right to use this software shall expire immediately and without notice. If the license expires, the user must immediately destroy this software and any portions of the user's works created using this software that relate to this software.
● No Warranty / No Liability
This software is provided without warranty. The author of this software is not concerned with any damages incurred by any person or object.
Furthermore, the author shall bear no responsibility for version updates, bug fixes, or any other maintenance of this software.
● Copyright Notice and Notification of Use
When using this software, there is no obligation to indicate to secondary users that this software was used. Furthermore, there is no obligation to notify the author of this software that you are using it.
It is forbidden to modify and redistribute the copyright notices included in the software or the version information resources (excluding the version number) of the Kirikiri core.
Additionally, starting the Kirikiri core with the '-about' option displays detailed copyright information; modifications that suppress this are prohibited.
As an exception, if you add a note to the documentation distributed to secondary users stating that Kirikiri is being used and that details of the version information can be viewed by starting Kirikiri with the '-about' option, you are permitted to modify and distribute the version information resources of the Kirikiri core.
● Redistribution
This software cannot be redistributed without this license document. Additionally, no monetary exchange may accompany the distribution of the software itself (excluding necessary expenses such as media costs).
However, the following exceptions apply:
・Kirikiri 2 execution core (krkr.eXe)
・Kirikiri plugins included in the Kirikiri SDK distribution files
・KAG system (each file under kag3\template)
・KAG plugins included in the Kirikiri SDK distribution files
Files falling under the above items can be distributed without this license document along with the works of the user who utilizes these execution cores, etc. In this case, the distribution as a whole can be distributed based on the distribution license specified by that user.
The user-specified distribution license may be based on commercial distribution, free distribution, open source, or closed source.
However, the license for the items mentioned above themselves does not change. If these execution cores or systems are separated from the distribution, or considered separately, the original license shall be maintained.
The End-User Kirikiri Settings (エンジン設定.exe) may be distributed without this license document only for the purpose of allowing secondary users to configure Kirikiri themselves.
The File Corruption Check Tool may be distributed without this license document only for the purpose of allowing secondary users to check for file corruption themselves.
● Diversion, Modification, and License Changes
This software is open source. The software source can be obtained from the Kirikiri Support Page; if that is impossible, please contact the author.
The source of this software, or fragments thereof, can be diverted and incorporated into other software. This applies regardless of whether it is open source or closed source.
Here, diversion indicates that a part of this software is incorporated into other software.
You may modify and distribute this software, but in this case, it can only be distributed under the same license as this software, or a license specifically approved by the author of this software.
Modification indicates making changes to this software. However, using the binary exactly as distributed by the author without changes (excluding changes such as customization via included tools or modifications to version information resources permitted under the [Copyright Notice and Notification of Use] conditions above) is not considered a modification.
In the case of both diversion and modification, it is necessary to either state in the documentation, etc., that the source or binary included in this software is being used, or to contact the author in advance to confirm the distribution, or both.
Regarding the preceding sentence, the author may publish a list of software for which "notification and confirmation of distribution to the author" has been performed only to those who request it.
However, as an exception, the KAG system (each file under kag3\template) is open source, but there are no restrictions or obligations regarding diversion or modification.
● Plugin Creation
To create plugins, you may use tp_stub.h, tp_stub.cpp, and tvpsnd.h included in the Kirikiri source.
When incorporating and using these files in a plugin for the purpose of plugin creation, it is not considered diversion or modification as described above. Therefore, in this case, there is no need to perform the "stating in documentation that source is used or notifying the author" mentioned above. Furthermore, there is no need to publish the source code of the plugin.
However, if parts of the Kirikiri source other than these files are incorporated into a plugin, or if these files are used for purposes other than creating a plugin, it will be considered diversion as described above.
● Application of Patches/Code
When applying patches or additional code from someone other than the author to the original source of this software and providing feedback to the author (contributing), it is a condition that the license of those patches or code can be applied under the license of this software (dual license of GNU GPL and this license).
● License Changes by the Author
The author of this software may change/modify this license without notice. However, the new license will not apply retroactively to old software distributed with the old license.
● Regarding ERI (Eri-chan)
The Kirikiri core includes an expansion library for the image format "ERI" by Mr. L.Entis. When using this format, please pay particular attention to the license regarding ERI. This is not relevant if you do not use this format.
For details, please refer to Eri-chan club
